1. Services

Nepal DMC Tours provides travel-related services including tours, trekking, transportation arrangements, guide services, accommodation bookings, and related travel arrangements (collectively, the “Services”).

All services are subject to availability, and bookings are confirmed only upon full or partial payment and acceptance by us.

2. Booking, Payment & Cancellation

a) Booking:

• You may make a booking via our website, email, phone, or authorized agent.
• You must provide accurate and complete information.
• We reserve the right to refuse any booking.

b) Payment:

• We may require a deposit or full payment prior to confirmation.
• Payment methods accepted will be specified (e.g. bank transfer, credit card).
• If payment fails or is declined, we may cancel or withhold services.

c) Cancellation & Refunds:

• Cancellations must be made in writing (email).
• Cancellation fees may apply depending on how far in advance you cancel.
• Refunds (if any) will be processed after deducting applicable fees and costs.
• In case of force majeure (natural disasters, political instability, etc.), we may reschedule or cancel with limited liability.

3. Changes & Substitutions

We may need to make changes to the itinerary, accommodations, transport, or services due to unforeseen circumstances. We will endeavor to notify you in advance, and provide reasonable alternatives. You agree not to hold us liable for minor alterations.

4. Travel Documents, Visas & Health

You are responsible for obtaining and carrying valid passports, visas, permits, vaccinations, insurance, and meeting health requirements. We are not liable for penalties or expenses arising from your failure to comply.

5. Assumption of Risk & Waiver

Travel involves inherent risks (injury, illness, accidents, loss). By using our Services, you accept those risks. You agree to release, indemnify and hold harmless Nepal DMC Tours, its agents, employees, and partners from claims, losses, liabilities, or expenses arising from your participation, except where caused by our gross negligence.

6. Insurance

You must procure adequate travel insurance (health, accident, liability, evacuation) covering your entire trip. Our liability is limited to services we provide; your insurance covers broader risks.

7. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability to you for any claim (contract, tort, negligence) is limited to the total amount you have paid us for the service in question.
• We are not liable for indirect, incidental, special, or consequential damages (e.g. loss of profits, loss of enjoyment).
• We are not liable for delays, cancellations, mechanical failures, weather, strikes, government actions, or other events beyond our control.

8. Intellectual Property

All content on the Site (text, images, logos, graphics, video) is the property of Nepal DMC Tours or its licensors, protected by copyright, trademark, and other laws. You may not reproduce, distribute, adapt, or create derivative works without our written permission.

9. Prohibited Conduct

You agree not to:

• Interfere with Site operation or security
• Upload viruses, malware, or harmful code

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of Nepal. Any disputes will be resolved through negotiation or mediation. If unresolved, disputes may be submitted to courts in Nepal.

11. Severability & Waiver

If a provision is deemed invalid or unenforceable, the other provisions remain in effect. Failure to enforce a right does not constitute a waiver of that right.

12. Changes to Terms

We may revise these Terms at any time. The “Effective Date” will be updated. Continued use of the Site or Services after changes constitutes acceptance of the new Terms.
